Since 1994, Switzerland has had an article in its Criminal Code that criminalizes public incitement to hatred and discrimination based on race, ethnicity or religion (anti-racism criminal provision). In 2020, this article of the Criminal Code was extended to include sexual orientation. Since then, the relevant article has been 261bis of the Swiss Criminal Code: <\/p>\n\n

Anyone who publicly incites hatred or violence against a person or a group of persons because of their race, ethnicity, religion or sexual orientation. Discrimination<\/a> who publicly disseminates ideologies aimed at the systematic disparagement or defamation of such persons or groups of persons,who with the same aim Propaganda campaigns<\/a> organizes, promotes or participates in the organization, promotion or participation of anyone who publicly, by word, writing, image, gesture, assault or in any other way, harasses a person or a group of persons because of their race, ethnicity, religion or sexual orientation in a manner contrary to the law. Human dignity<\/a> disparages or discriminates in a manner that is contrary to the law or for any of these reasons Genocide<\/a> or other Crimes against humanity<\/a> denies, grossly trivializes or seeks to justify, whoever refuses a service offered by him which is intended for the general public to a person or a group of persons because of their race, ethnicity, religion or sexual orientation is liable to a custodial sentence not exceeding three years or a monetary penalty.<\/p>\n\n
